Please read these terms carefully before using our website or holiday-planning services.

Welcome to Global India Getaways (“GIG”, “we”, “us” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of globalindiagetaways.com (“Website”) and the products, holiday plans, offers and services made available through the Website.

By accessing or using the Website, submitting an enquiry, purchasing any product or availing any service, you acknowledge that you have read, understood and agreed to these Terms.

1. About Global India Getaways

Global India Getaways is a travel and holiday solutions provider offering Holiday Entitlement Plans (HEP), holiday accommodation benefits and other travel-related products and services.

The Website provides information about our products, destinations, offers and services and enables customers to submit enquiries and communicate with us.

Information displayed on the Website does not by itself constitute a confirmed booking or reservation.

2. Holiday Entitlement Plans

HEP provides eligible customers with holiday accommodation entitlements for the validity period and destination coverage specified in their selected plan.

The entitlement, validity, payment schedule, holiday eligibility, Annual Service Fee (ASF), booking conditions, cancellation, refund provisions and other benefits may vary depending on the plan selected.

The specific terms accepted by the customer at the time of enrolment shall apply to that customer's HEP.

3. HEP Application and Agreement

For an HEP purchase, the completed and accepted HEP Application, applicable HEP Terms & Conditions, Holiday Eligibility & Payment Terms, payment records, joining offer terms (if applicable) and booking confirmation shall together constitute the applicable customer documentation.

In case of any inconsistency, the specific terms applicable to the customer's accepted HEP shall prevail, subject to applicable law.

4. Holiday Entitlement

Unless specifically stated otherwise in the selected HEP, the standard entitlement is up to 7 nights per HEP year.

Holiday entitlement is subject to the applicable plan conditions, payment eligibility, availability, booking requirements, blackout periods, peak-season conditions and other applicable restrictions.

A holiday entitlement does not represent ownership of any hotel, resort, property or other real estate.

5. Holiday Booking

Holiday bookings are subject to availability.

Submitting a booking request does not constitute confirmation. A booking becomes confirmed only when an official confirmation is issued by GIG.

GIG does not guarantee a particular hotel, room category, destination or travel date unless specifically confirmed in writing.

Customers are advised to submit booking requests within the applicable booking notice period stated in their HEP Terms & Conditions.

6. Hotels and Third-Party Service Providers

GIG may arrange accommodation through hotels, resorts, travel suppliers, booking platforms and other third-party service providers.

Hotel facilities, room categories, photographs, policies, meal arrangements and other services may vary and may change without prior notice.

Where applicable, the terms and conditions of the relevant hotel or service provider shall also apply.

7. Prices and Offers

Prices, plans, promotional offers and complimentary benefits displayed on the Website may be changed, modified, withdrawn or discontinued from time to time.

A promotional or complimentary offer shall be subject to the specific conditions communicated with that offer.

The price and terms specifically accepted by a customer at the time of purchase shall apply to that transaction, subject to applicable law.

8. Joining and Complimentary Offers

Where a Complimentary Holiday or other promotional benefit is offered as part of a joining offer, it shall be governed by the specific conditions of that offer.

Such benefits may have separate eligibility requirements, booking restrictions, availability conditions, validity periods and applicable charges.

A Complimentary Holiday is separate from the customer's regular HEP holiday entitlement unless expressly stated otherwise.

9. Payments

Payments must be made only through payment methods or payment gateways officially authorised by GIG.

A payment shall be considered received when it is successfully credited to the authorised GIG account or payment gateway and can be properly identified and reconciled.

Customers should retain payment receipts and transaction records for their reference.

GIG shall not be responsible for payments made to unauthorised persons, accounts, payment links or channels.

10. Holiday Eligibility and Payment Milestones

Holiday eligibility under an HEP is subject to the payment plan and milestones selected by the customer.

Where applicable, advance EMI payments may be considered towards the relevant holiday eligibility milestone once received and reconciled, subject to the applicable HEP Terms & Conditions.

No holiday shall be available while applicable payment obligations remain overdue or other eligibility conditions remain unsatisfied.

11. Annual Service Fee

Where applicable, the customer shall pay the Annual Service Fee (ASF) within the applicable due period specified in the HEP.

The ASF and any other applicable charges shall be governed by the customer's selected plan and accepted HEP terms.

Failure to pay applicable dues may affect holiday eligibility.

12. Booking Notice, Peak Periods and Blackout Dates

Holiday bookings may be subject to advance booking requirements, peak-season restrictions and blackout periods.

Certain high-demand periods may require longer advance notice and may be subject to additional charges or restricted availability.

The applicable HEP Terms & Conditions shall determine the booking notice requirements, peak periods, festival-season conditions and blackout dates applicable to the customer's plan.

13. Occupancy and Additional Guests

Standard accommodation occupancy shall be subject to the applicable hotel and HEP conditions.

Additional guests, extra beds, additional rooms, upgrades or other special arrangements may be subject to availability and additional charges payable by the customer.

14. Meal Plans

Where a meal plan is included in an HEP, the availability of such meal arrangements shall be subject to the facilities and policies of the confirmed accommodation.

Where the included meal plan cannot be provided at the confirmed accommodation, any applicable reimbursement or adjustment shall be governed by the customer's HEP Terms & Conditions.

No reimbursement shall ordinarily be applicable where the customer voluntarily declines, removes or chooses not to use an available meal arrangement.

15. Test & Try Plans

Any HEP having a validity period of less than 3 years may be classified as a Test & Try Plan, irrespective of the number of holiday nights included.

Test & Try Plans are subject to separate eligibility, booking, accumulation, advance-use and cancellation conditions as specified in the applicable HEP Terms & Conditions.

16. Free-Look Period

Where applicable, customers shall receive a Free-Look Period as specified in their HEP Terms & Conditions.

The applicable Free-Look Period may vary depending on the selected HEP.

Cancellation requests during the applicable Free-Look Period shall be processed in accordance with the applicable HEP Terms & Conditions and applicable law.

17. Cancellation and Refund

Cancellation and refund rights shall depend on the type of product, applicable HEP terms, payment status, booking status and applicable law.

For HEP purchases, the applicable Free-Look Period and cancellation provisions stated in the accepted HEP Terms & Conditions shall apply.

After expiry of the applicable Free-Look Period, amounts already paid shall ordinarily be non-refundable unless otherwise specifically provided in the applicable HEP terms or required by applicable law.

Where cancellation is eligible for a refund, GIG shall ordinarily process the eligible refund within 45 days from receipt and verification of a valid cancellation/refund request, subject to payment reconciliation and resolution of any related payment dispute or chargeback.

Refunds shall ordinarily be made through the original payment method or another mutually accepted method.

Where an eligible refund involves multiple payment transactions, payment channels or settlement processes, or where genuine banking, payment-gateway or reconciliation requirements make a single payment impractical, GIG may process the refund in three instalments. Such staged processing shall not reduce the customer's total eligible refund amount.

Where a chargeback or payment dispute relating to the same payment is pending, GIG may complete the applicable refund after the dispute is resolved or reconciled, so that duplicate recovery does not occur.

Nothing in these Terms shall exclude or restrict any refund or consumer right that cannot legally be excluded or restricted.

18. Cancellation of Confirmed Holidays

Cancellation or modification of a confirmed holiday shall be subject to the applicable HEP Terms & Conditions, hotel policies, supplier conditions and availability.

Certain cancellations, modifications, no-shows or changes may result in applicable charges, loss of entitlement or other consequences.

Customers should review the applicable cancellation conditions before requesting changes to a confirmed booking.

19. Customer Information

Customers are responsible for providing accurate and complete information required for enrolment, payment, verification, booking and service delivery.

Customers should promptly inform GIG of any change in their contact information.

GIG shall not be responsible for consequences arising from incorrect or incomplete information provided by the customer.

20. Website Content

We make reasonable efforts to keep Website information accurate and updated.

However, destination information, hotel facilities, photographs, prices, availability, travel information and other content may change from time to time.

Photographs and images on the Website may be representative and may not always depict the exact room, property or facilities ultimately provided.

21. Intellectual Property

All content on the Website, including the GIG name, logo, text, photographs, graphics, videos, designs, layouts and other materials, is owned by or licensed to GIG unless otherwise stated.

No Website content may be copied, reproduced, modified, distributed or commercially used without prior written permission from GIG.

22. Acceptable Use

You agree not to:

  • use the Website for unlawful or fraudulent purposes;
  • submit false or misleading information;
  • attempt unauthorised access to the Website or its systems;
  • interfere with the Website's operation or security;
  • copy or commercially exploit Website content without permission; or
  • use the Website in a manner that may damage GIG, its customers or third-party service providers.

23. Third-Party Links

The Website may contain links to third-party websites or services.

These links are provided for convenience or reference. GIG does not control such third-party websites and is not responsible for their content, availability, privacy practices or terms.

24. Privacy

Personal information submitted through the Website may be used for enquiry handling, customer communication, payment processing, verification, booking, service delivery, compliance and other purposes described in our Privacy Policy.

Personal data shall be handled in accordance with applicable law and our Privacy Policy.

25. Communication

Where you provide your contact details through the Website, GIG may contact you regarding your enquiry, product, booking, account, services, offers or other relevant information, subject to applicable law and applicable communication preferences.

26. Force Majeure

GIG shall not be responsible for delays, interruptions, cancellations or inability to provide services caused by circumstances beyond its reasonable control, including natural disasters, extreme weather, government restrictions, war, civil disturbance, strikes, epidemics, transportation disruptions, technical failures or actions of third-party service providers.

GIG shall make reasonable efforts to assist affected customers in accordance with the applicable plan or booking terms.

27. Limitation of Responsibility

GIG shall be responsible for fulfilling its obligations under the applicable HEP, booking or service agreement.

GIG shall not be responsible for losses arising solely from circumstances beyond its reasonable control or from the independent acts, omissions, policies or failures of third-party service providers, except where otherwise required by applicable law.

Nothing in these Terms shall limit any liability or statutory consumer right that cannot legally be limited or excluded.

28. Changes to the Website and Terms

GIG may modify, update, suspend or discontinue any part of the Website, its content, features or services from time to time.

These Terms & Conditions may also be updated when necessary. The latest version will be published on this page with the revised “Last Updated” date.

Changes shall not retrospectively alter specific contractual rights already acquired by a customer except where permitted or required by applicable law.

These Terms & Conditions shall be governed by the laws of India.

Nothing in these Terms & Conditions shall prevent a consumer from exercising any statutory right or approaching a competent consumer commission, authority or forum having jurisdiction under applicable law.

31. Severability

If any provision of these Terms & Conditions is held to be invalid or unenforceable under applicable law, the remaining provisions shall continue to remain effective to the extent permitted by law.

32. Entire Agreement

These Website Terms & Conditions, together with the Privacy Policy and other policies specifically referred to on the Website, govern your use of the Website.

For HEP customers, the accepted HEP Application, HEP Terms & Conditions, Holiday Eligibility & Payment Terms, payment records, applicable joining offer and booking confirmation shall additionally govern the specific HEP transaction.
